Labor Relations & Human Resources

 

Capital Region BOCES offers its participating districts access to professional labor relations advice and representation through its Labor Relations and Negotiations Service as well as Human Resources. This service, which is staffed by professionals with extensive experience in all aspects of labor relations and human resources, is designed to provide prompt and efficient service to participating school districts as they confront a wide variety of difficult labor relations and human resourcce issues.

Regional Database Development:

In recognition of the fact that collection and manipulation of data about employee compensation is a fundamental need of every school district as it enters into collective negotiations with its employees, Capital Region BOCES has joined with WSWHE BOCES and Questar III BOCES to offer their component districts and other districts across the state access to sophisticated data analysis that allows districts to compare their employee compensation plans, as well as their demographics, against other schools in the region.

Contract Negotiations:

At the core of the services offered by the Labor Relations Service is at-the-table representation of school districts during collective bargaining, including all activities from developing original proposals through the ratification of the agreement.

Quantitative Analysis:

Although some school districts have business office staff available to properly cost out various collective bargaining proposals, others are unable to have their in-house staff devote the necessary time and resources to this vitally important aspect of the negotiations process. In order to ensure the task is properly done, the Labor Relations Service is prepared to run the necessary numbers.

Labor Consultation & Contract Maintenance:

The experienced staff of the Labor Relations Service is available to respond to and offer advice upon a wide variety of issues that arise under the complex collection of statutes, rules and decisions of both courts and administrative tribunals that regulate the employment of school district staff. The service
provides consultations and assistance in the following areas: (not an all-inclusive list)

  • Seniority and Tenure

  • Internal investigations

  • Civil Service rules and regulations

  • ADA, FLSA, FMLA

  • Workers Compensation Claims

  • Federal and State Anti-discrimination laws

  • PERB Representation

  • APPR

  • Certification

  • HR Audits

  • Health Insurance including the ACA

  • Employee Discipline, including Section 75 and Counseling Memos

  • Hiring and Layoff

  • Issues related to the Department of Labor and Division of Human Rights

Grievance Arbitration Advocacy and Other Misc. Labor Services:

The Labor Relations Service is also available to provide representation on contractual grievances, up
to and including arbitration, investigation and/or representation on employee discipline matters, and other employment-related services for which component districts request assistance.
